In December 2009, his presence in the country was marred by legal woes when he was arrested by the Drug Enforcement Administration (DEA) on charges related to drug trafficking. Following a protracted legal battle, Banton was convicted in 2011 and subsequently served an almost ten-year sentence, finally regaining his freedom in December 2018 from McRae Correctional Institution in Georgia.
