Prime Minister Dr. Andrew Holness has challenged the national debate over Jamaica’s firearms laws by asking who speaks for the victims of gun violence, as he recounted visiting the family of a woman who was shot and killed. The Prime Minister’s comments came amid discussions with members of the Bar Association of Jamaica over the Firearms Act, with the legal fraternity calling for greater flexibility in exceptional cases while maintaining that it supports tough penalties for illegal firearm offences.

The Bar Association has raised concerns about the mandatory minimum sentence of 15 years, arguing that judges should have some discretion to consider exceptional circumstances. It has also called for sections of the legislation to be revisited, including provisions dealing with imitation firearms and how possession should be treated in cases involving minors. The Association stressed that it does not oppose the broader framework or the use of strong penalties against those who use guns to commit offences.

Holness, however, made it clear that any review must not weaken Jamaica’s fight against illegal guns. He defended the Government’s approach, pointing to the decline in murders and shootings following the introduction of the legislation, while also crediting increased national-security spending, intelligence gathering, preventative strategies and institutional development. He acknowledged that the law is not perfect and said Government had already been considering potential amendments before the Bar Association raised its concerns.

The most emotionally charged moment came when Holness recounted visiting the mother of a young woman killed by gunmen. He questioned why there was not similar public advocacy for families devastated by illegal firearms, asking, “Where are the protests for those?” The Prime Minister said the rights of accused persons must be balanced against the experiences of victims and their families, while insisting that the Government could refine the law without compromising its objective.

Holness stopped short of promising that the Bar Association’s recommendations would be accepted, stressing that any proposed changes must pass through the appropriate review and legislative processes. The central issue now is whether Jamaica can preserve tough firearms penalties while giving the courts enough flexibility to protect innocent people from an overly rigid law.
